Terms of Service

Last updated: 15 October 2026

1. Acceptance of Terms

Caching Out and Caching Out Pro are provided by Daga.pl sp. z o.o., a limited liability company registered in Poland (KRS 0001093024, NIP 7743286204, REGON 528017322, share capital PLN 5,000.00), with its registered office at ul. Zbożowa 7/9, 09-410 Płock, Poland (“Caching Out”, “we”, “us”). You can reach us at support@cachingout.com.

By purchasing, downloading, or using Caching Out Pro (“the Software”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. License

Caching Out Pro is licensed, not sold. Your purchase grants you a non-exclusive, non-transferable right to use the Software on the number of WordPress sites specified by your license tier (Single: 1 site, Plus: 3 sites, Multi: the site count purchased — 50, 100, or 500 sites; Enterprise: as agreed in your contract). While your licence is active it includes updates, support and the AI Assistant. The free Caching Out plugin distributed on WordPress.org is licensed under the GNU General Public License; nothing in these terms restricts your rights under that licence.

The AI Assistant is fair-use limited (currently 50 questions a day and 300 a month per licence) and is scoped to questions about Caching Out and your site’s configuration; it is not a general-purpose AI chatbot. Its answers are generated by an AI model and can be wrong — check anything consequential against the documentation.

3. Price and Payment

The price of each plan is the one shown on the pricing page when you buy, in US dollars. You pay by card; the payment is taken by our payment processor, Stripe, on its own payment page, and Stripe keeps your payment method so that renewals can be charged. We never see or store your card details. Prices are shown without tax. Where VAT or another sales tax applies to your purchase, it is calculated from your billing address, shown at the checkout before you pay, and added to the amount charged; your order confirmation shows it as a separate line.

4. Term, Renewal and Cancellation

A licence is a yearly subscription. It runs for one year from the date of purchase and renews automatically at the end of each year for a further year, charged to the payment method you used, at the price you paid. If we ever change the price of your plan, we tell you by email at least 30 days before the first renewal it would apply to, so you can cancel before then. About two weeks before each renewal we email you the date and the amount.

You can cancel at any time from your account (Subscriptions, then “Cancel at the end of the period”). Cancelling stops the next renewal and nothing more: your licence, updates, support and the assistant continue to the end of the year you have paid for, and nothing is refunded by cancelling. Until that day you can change your mind with “Keep my subscription”.

If a renewal payment fails, we email you and Stripe retries the payment over the following two weeks; your licence stays valid meanwhile. If the payment cannot be collected, the subscription ends and the licence lapses.

If your licence lapses, the plugin keeps doing its job. Updates, support and the assistant stop until you renew, which you can do from your account. The free Caching Out plugin is unaffected.

5. Refunds and Your Right of Withdrawal

We offer a 14-day money-back guarantee on every plan and on every renewal payment: write to support@cachingout.com from the email address on your account within 14 days of the payment and we refund it in full, to the original payment method. How long the money takes to reach you depends on your bank or card issuer. If you take up the money-back guarantee, Pro switches off and your site carries on with the free plugin; the subscription ends with the refund.

If you buy as a consumer in the European Union or the United Kingdom, you also have a statutory right to withdraw from the purchase within 14 days. Because your licence is digital content that we supply immediately, at checkout you ask us to supply it straight away and acknowledge that this ends the statutory right of withdrawal once the licence has been supplied; your order confirmation repeats that acknowledgement. The money-back guarantee above is not affected by it and is in addition to any statutory right that remains.

6. Limitation of Liability

The Software is provided “as is” without warranty of any kind. Caching Out shall not be liable for any damages arising from the use or inability to use the Software, including but not limited to data loss, site downtime, or lost revenue. You are responsible for maintaining backups of your site before installing or configuring any performance plugin. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or for your statutory rights as a consumer.

7. Governing Law

These terms are governed by the laws of Poland, and disputes are brought before the courts of Warsaw. If you are a consumer resident in the European Union, you keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings there.
